By installing, accessing, registering or using any websites: motability.co.uk, myaccount.motabilityoperations.co.uk, activate.motabilityoperations.co.uk and id.motabilityoperations.co.uk   (the  “Website”),  emails,  newsletters,  including  any  technologies  or devices  by  which  Motability  Operations  Limited  makes  any  of  the  Websites  available  to  you  at home or on the move and any other digital properties (together, “Digital Services”) that reference these Website Terms and Conditions (“T&Cs”), you confirm that you have read, understood and agree  to  these  T&Cs  in  their  entirety.  If  you  do  not  agree  to  these  T&Cs,  you  must  not  use  the Digital Services.

Your use of the Websites and/or the Digital Services and their contents grants no rights to you in relation  to  our  intellectual  property  rights,  or  that  of  third  parties,  in  the  Websites  or  the  Digital Services. You are permitted to print or download content for your own personal use only. You must not use any material on the Websites or the Digital Services for any commercial purpose or any other website, unless prior written permission has been sought.

To the extent permitted by applicable law, Motability Operations disclaims all representations and warranties, express or implied, that content or information displayed in or on the Websites and/or the  Digital  Services  is  accurate,  complete,  up-to-date  and/or  does  not  infringe  the  rights  of  any third party.

The  views  expressed  in  user  generated  content  are  the  opinions  of  those  users  and  do  not represent  the  views,  opinions,  beliefs  or  values  of  Motability  Operations  or  any  of  its  group companies.


Damage to your computer or other device

Motability Operations uses reasonable efforts to ensure that the Websites and the Digital services are free from viruses and other malicious or harmful content. However, we cannot guarantee that your use of the Websites (including any content on it or any website accessible from it) and/or the Digital Services will not cause damage to your computer or other device. It is your responsibility to ensure that you have the right equipment (including antivirus software) to use the Websites and the Digital Services safely and to screen out anything that may damage or harm your computer or other devices. We have placed links on the Websites and the Digital Services to other websites we think you may want to visit. We do not vet these websites and do not have any control over their contents. Except where required by applicable law, Motability Operations cannot accept any liability in respect of the use of these websites.

Limitation on Motability Operations’ liability

Motability Operations shall not be liable for any direct or indirect lost profits or business damage (including loss of opportunity), special, indirect, consequential, exemplary or incidental damages, including lost data, personal injury, or property damage related to or arising out of or in connection with the use of the Website and/or Digital Services.

Provision of the Website and Digital Services 'as is'

The Website and Digital Services may include inaccuracies or errors. Motability Operations provides the Website and Digital Services 'as is' and without warranties of any kind either expressed or implied. Motability Operations disclaims all warranties of suitability and fitness for a particular purpose. Motability Operations does not warrant or make any representation that the Website and/or the Digital Services will be accurate, reliable, uninterrupted or error-free, that defects will be corrected, or that the Website and/or the Digital Services are free of viruses or other harmful components. You assume total responsibility related to your use of the Website and Digital Services. Neither we nor any other person or organisation involved in producing or delivering the Website and Digital Services are responsible for, nor shall be liable (to the fullest extent permitted by law) for, any damage to or viruses that may infect your computer equipment or other property as a result of you accessing, using or browsing the site or downloading any content from the Website and/or the Digital Services. Governing law and jurisdiction

The T&Cs and your use of the Websites and Digital Services are governed by and construed in accordance with the laws of England and Wales and any disputes will be decided exclusively by the Courts of England and Wales.
